Homeschooling and the Law

As of the writing of this article, the option to homeschool is legal in all 50 states of the United States and in many other countries around the world. What is vitally important before you begin your homeschool journey is to familiarize yourself with the homeschool laws of your specific state and/or country as All Homeschool Laws Are Not Created Equal.
Since I do not have a legal background and it would be impossible and I think ultimately very irresponsible to try to capture the scope of the legal requirements of all states and even countries here on this site, I will instead share with you a resource which for most of our 18 plus years of homeschooling has been our go to resource for all things legal when it comes to homeschooling. I truly cannot recommend this resource enough, and would suggest that anyone thinking about homeschooling become acquainted with this excellent resource - the Homeschool Legal Defense Association or HSLDA.
This resource will provide you with all the specifics as it corresponds to the specific homeschool laws of your state and can provide you with legal homeschool support throughout your homeschool journey.
Here is who they are in their very own words as taken from their website HSLDA under their "what we Do" Page:
"We believe that every child deserves a quality education—and homeschooling is one of the best ways to achieve that. No other form of education allows the kind of customization and personalization that homeschooling does. As a homeschooling parent, you are free to teach your child at her own pace, follow her interests, and craft an education plan that meets her specific needs. The result is a unique educational experience that equips your child with the skills and opportunities she needs to really thrive.
We also believe that parents are typically better suited than the government to determine what kind of education works best for their children. Parents know their children’s needs and abilities much better than any government official can—and they’re better able to find ways to meet those needs and nurture those abilities. And so when parents are free to choose and direct their children’s educational experience, it sets the stage for children to thrive.
Our goal: Your child’s success
Because of these beliefs, we’ve made it our goal to tirelessly advocate for the right to homeschool—in courts, legislatures, and anywhere else we can make ourselves heard. Ultimately, we’re here to empower and encourage homeschooling parents as they seek to teach their children in a way that celebrates their uniqueness and nurtures their love of learning.
In short, our mission is to make homeschooling possible.
We know that homeschooling isn’t the best fit for everyone, and that’s okay. What’s important is that every family, regardless of ethnicity, religious background, or economic status, has the freedom to choose how their children are educated—and the support they need to help their children flourish.
For over 35 years, HSLDA has worked to make homeschooling possible for every family that wants to do it. And we’ll continue to make it possible for as long as we’re around." - HSLDA
Please visit HSDLA as one of the first things on your list of things to do if you are considering homeschooling. Making sure that you are following the laws of your homeschool state will ensure that you begin on the very best foundation for a successful homeschool journey.
